Terms and Conditions for Practice Warriors 1-on-1 Private Music Coaching with Christopher Maloney

Welcome to Practice Warriors ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our online music lessons and coaching services ("Services"). By subscribing to and using our Services, you agree to comply with these Terms.

1. Service Overview

1.1. Subscription Service: By signing up for a subscription, you will receive four (4) coaching sessions each month, where each session includes personalized music instruction, feedback, and coaching.
1.2. Session Delivery: The coaching sessions will be delivered online via live video conferencing or pre-recorded video lessons, as determined by the coach or agreed upon with you.

2. Subscription and Payment

2.1. Monthly Subscription: To access our Services, you must sign up for a monthly subscription through our website. The subscription will include four (4) coaching sessions per month.
2.2. Payment Method: You agree to provide a valid credit card to pay for the subscription, which will be billed on a monthly basis. Payments will automatically renew unless canceled.
2.3. Billing Cycle: Subscriptions are billed monthly, and the payment will be processed at the start of each billing cycle. If payment is unsuccessful, access to the Services may be suspended until payment is successfully completed.
2.4. Price Changes: We reserve the right to adjust the subscription price. You will be notified in advance of any price change, and you will have the option to cancel before the new rate takes effect.

3. Scheduling and Cancellations

3.1. Session Scheduling: You will be able to schedule up to four (4) coaching sessions per month through our website. Sessions must be scheduled at least 24 hours in advance.
3.2. Cancellation Policy:

• If you need to cancel a session, you must notify us at least 24 hours prior to the scheduled session time.

• If a session is canceled within 24 hours of the scheduled time, we will provide a pre-recorded video lesson as a substitute for the canceled session.

• No refunds or credit will be issued for missed sessions, unless a session is canceled by us due to unforeseen circumstances. In this case, we will offer an alternative rescheduling or a video lesson.

4. Content and Use of Services

4.1. Access to Lessons: You will receive membership access to Practice Warriors as part of the coaching program. All video lessons, materials, and content provided are for your personal use only and cannot be shared, distributed, or resold.
4.2. Intellectual Property: All content provided by us, including but not limited to video lessons, written materials, and other educational resources, are protected by copyright. You agree not to copy, reproduce, or distribute any of this content for commercial purposes without explicit permission.
4.3. User Responsibility: You are responsible for ensuring that you have the appropriate technology (e.g., device, internet connection, etc.) to access the lessons and participate in the sessions.
4.4 Practice Warrior Membership Expiration: Your access to the complimentary Practice Warriors membership expires with the ending of your monthly subscription to the 1-on-1 Private Music Coaching. 

5. Account and Security

5.1. Account Creation: You must create an account through our website to access our Services. You agree to provide accurate and complete information when creating your account and to update it as necessary.
5.2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account.

6. Termination and Suspension

6.1. Subscription Cancellation: You may cancel your subscription at any time through your account settings on our website. Cancellations will take effect at the end of the current billing cycle, and no refunds will be issued for unused portions of the current month.
6.2. Suspension or Termination of Service: We reserve the right to suspend or terminate your access to our Services at any time, for any reason, including violation of these Terms, failure to pay, or other conduct that we deem inappropriate.

7. Limitation of Liability

7.1. Limitation of Liability: To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages resulting from your use of the Services, including but not limited to the loss of data or missed sessions.
7.2. No Warranty: Our Services are provided "as is," and we make no warranties, express or implied, regarding the quality, accuracy, or effectiveness of the Services.

8. Modifications to Terms

8.1. Amendments: We may revise these Terms from time to time. Any changes will be posted on our website, and the revised Terms will become effective immediately upon posting. By continuing to use our Services after changes are made, you accept the updated Terms.

9. Governing Law

9.1. Jurisdiction: These Terms are governed by the laws of the state of Florida, without regard to its conflict of law principles. Any disputes relating to these Terms will be resolved in the appropriate courts of the state of Florida.
